Premarital sex and marriage - Why the judges are right !

A couple of days ago, the Madras high court issued an order that has been the subject of ridicule and mockery on every form of media including the many social networking sites. Some of my friends who like me are highly opinionated have taken to these sites to have a jest at it. Their opinion differs from mine, but that's not what saddens me. What saddens me is that, almost all of their ridicule are based on incomplete information and blatant lies. 

First with this case:
This story, like any others brought to an Indian court, starts a long time ago. A man and his girlfriend lived together for five years before they separated. The woman bore two children out of this relationship, making our boy their biological-father. But once they separated, the guy stopped paying child support and the woman sought the intervention of the court. 

The lower courts ruled out her case stating that the couple weren't legally married and hence the guy wasn't responsible for child care. The woman took her case to the high court and there, she won it. 

The reasons behind this verdict from the high court,
1) The guy and girl had co-inhabited for long enough to be considered married.
2) They had had intercourse with mutual consent.
3) The guy had declared him as the her husband when he signed the hospital papers when she got pregnant.

In this case, the judges gave a verdict that was legally and morally correct, by overruling the need for a customary religious ceremony to make a marriage legal. 

Taking a closer look at the judgement, it seems evident that the judges were motivated by a desire to provide better protection for women and children of this country who are abandoned by the men. I believe that is a step forward for the female community, a good outcome of this case.

The judges have promised to go about this law on a case-to-case basis. But I think it should be enforced without any conditions for every case. And why ? 

Soon after the verdict came out, while countrymen who pose themselves as modern thinkers and believers of progressivism cackled all over the internet after hearing half-baked stories, the orthodox and the conservative jumped in to the fray in support of the religious ceremonies. They protest that the verdict compromises religious sentiments and the cultural integrity of the country. 

To all these people, all I say is, please learn your history. And I'm here to teach you a few things.

History behind thali (mangalsutra):
When ancient humans were still nomads, their sexual relationships were untamed. It was the times when Men sought the company of women who already had sexual relationships with another man. To prevent this from happening, men who were possessive of their women, adorned their women with a necklace that had their names engraved on it. 

This chain served as a warning to any man who approached a woman who had already been taken. This, over the centuries, after numerous upgrades has turned into the thali. 

So, thali was introduced just as a binding document that proclaimed who should have SEX with a woman. To prevent someone  else from having SEX with her. 

Metti(rings worn by women in the forefingers of their feet) and kungkumam(sindhoor): 
It has been scientifically proven that wearing metti and kungkumam after marriage helps in quick conceiving. A nerve in the forefinger of the feet of a woman and another in the top of the forehead is said to control the movement of the eggs. Wearing metti and kungkumam has been found to keep that production and movement of the eggs organized and regular. 

Once again SEX and marriage. 

I hope the orthodox learn that behind every religious ceremony that is in practise, there is some link to SEX. Because it is not just pleasure, it is the essence of life. A way to pass our identities beyond our time. 

SEX is a means to IMMORTALITY. That is why it must be respected and had with just one person. 

In the modern India, where people have lost all sense of identity and culture and have been blinded by western influence, SEX has become a cheap commodity. It is offered to many without reluctance and accepted without guilt. 

The educated, who have access to western cultures, consider sex just as a physical pleasure and enjoy it with many without any burden of commitment  The uneducated envy the privileged and indulge in sex that is unethical and sometimes, illegal(rape). Though the later commit most of the crimes against women, the former are equally responsible. 

Now this verdict offers a chance to change all that. Any man/woman who wishes to have sex with another will now think about the burden of commitment before indulging in it. And once again, sex can become the essence of life from being mere physical pleasure. 

We have pulled this wonderful country to the great depths of cultural immorality where the only way we can go forward is by going backward.

can you point me to the scientific proof of thali and kungumam?

There is no scientific proof for the invention of thali. I bumped into it in a research of mine. Found that every part of Tamil Nadu has its own folklore regarding this. Villages around Thanjavur and Madurai have the most.

About Kungukamam, I read it in an independent research paper published a few years ago by an English lady. Her name is RIley something... Tried finding her link... but I couldn't.
